A Union Grove man is facing a pair of felony charges after allegedly attacking his father while drunk Nov. 25.
Brian Hardy, 51, was charged in Racine County Circuit Court Monday with aggravated battery of an elderly person, repeater, with domestic abuse assessments and strangulation and suffocation, again with domestic abuse assessments. Both are felony charges, and Hardy was also charged with misdemeanor resisting an office and disorderly conduct/domestic abuse – both with repeater charges.
Hardy was being held in Racine County jail on a $5,750 cash bond as of Monday night.
According to the criminal complaint, the Racine County Sheriff’s Department was dispatched to State Street in Union Grove just before midnight Nov. 25. When the deputy arrived, Hardy was reportedly in the hallway passed out.
While waiting for rescue to arrive, the deputy allegedly smelled a strong odor of intoxicants coming from Hardy, who also had trouble answering simple questions. Another deputy arrived, and while the first talked to Hardy’s parents, the second watched Hardy and reported him becoming “aggressive.”
Hardy allegedly resisted getting into the squad car, but was finally put inside. The deputies then talked with the mother, who alleged that the father and Hardy had gotten into an argument. According to the mother, the father took his dinner into another room to get away from Hardy, but Hardy followed and later allegedly smashed the plate into his father’s face and tried to choke him as well.
The father confirmed the story. According to the parents, Hardy also resides at the address. Hardy, according to the complaint, has previous convictions for drunken driving, disorderly conduct and operating a firearm while intoxicated.
