A 43-year-old man living at a Department of Veterans Affairs cottage in Southern Wisconsin Center was arrested after a couple found him inside their home.
According to the complaint filed in Racine County Circuit Court:
Police were called Sept. 16 after a couple living on Tenth Avenue in Union Grove reported an intruder had entered their home.
The wife told police she came downstairs after their dogs began barking. She found a man standing in the living room who told her that “Barry said he could stay here.”
Her husband then came downstairs and told the intruder to get out. Though visibly upset, the intruder left.
The wife said she noticed the intruder was wearing one of her shoes and one of her husband’s shoes.
The husband ordered the intruder to put on the hiking boots the man had left outside in the driveway near the husband’s pickup truck, which he did.
The husband said that while in the driveway, the intruder reached into his right front pocket and pulled out a gray folding knife and tried to open it. The husband said he recognized the knife as his, and had last seen it a day earlier on a table in the living room.
The husband asked for the knife back, and the man gave it to him.
As the man started to walk away, he told the husband that he would be back and bring a motorcycle gang with him.
The man then walked west to a bicycle left at the intersection of Tenth Avenue and York Street, and rode west towards the Southern Center grounds.
The couple showed police several ID cards left in their pickup truck belonging to a Derek R. Osborne. They identified the intruder from a photo ID on one of the cards.
The couple said Osborne appeared to be “wired” and confused.
Osborne was located in the area by police, taken into custody and transported to the Racine County Jail. He told police he was “lawyering up” and refused to make a statement.
Osborne is charged with felony counts of burglary to a dwelling and burglary while armed with a dangerous weapon. He is scheduled for a preliminary hearing in Racine County Circuit Court Sept. 26.
Osborne is also scheduled for a review hearing in Milwaukee County Circuit Court Oct. 3 in connection with a Feb. 8 incident for misdemeanor theft and misrepresentation.
On May 23, Osborne was given a finding of deferred prosecution/sentence on that Milwaukee County charge. Court records show him as living on West Wells Street in Milwaukee at that time.
