A Burlington man who was injured in a motorcycle crash April 6 on County Road FF, Rochester, has been charged with his fifth felony offenses of operating while intoxicated and operating with a prohibited alcohol concentration.
According to the criminal complaint filed May 30 in Racine County Circuit Court:
A Maryl Street resident called police when he stepped outside of his garage to check on an unusual sound from a passing motorcycle, and observed the motorcycle flipping up in the air, flying end-over-end along with its operator.
The motorcycle and driver then came to a stop north of Maryl Street in the north ditch line of W. West Street.
The driver was observed to be unconscious. He was subsequently identified as Alan A. Martin, 53, of Burlington.
Deputies who arrived on scene reported the driver was laying face down in the ditchline next to the motorcycle.
He was conscious and speaking, and an odor of intoxicants was reported. Martin reportedly admitted to rescue personnel that he had had a few drinks.
He was taken by Flight for Life to Froedtert Medical Center, Milwaukee. A test of his blood alcohol concentration found it to be 0.308, or nearly four times the legal limit for driving in Wisconsin.
An examination of the crash scene found that the vehicle had left the road about 231.5 feet from where it finally came to rest. Marks also showed that it continued in the gravel and into the ditch line for more than 210 feet before finally catching in the ground, causing the motorcycle to start flipping.
Martin made an initial appearance in Racine County Circuit Court June 11, where probable cause was found that he had committed the crimes with which he is charged.
A $10,000 signature bond was set, with conditions that Martin not consume or possess alcohol, and submit to alcohol consumption monitoring.
He is next due in court June 27 for a preliminary hearing.
